1. Purpose and Scope

These Terms and Conditions ("Terms") govern your use of the SAM&ME platform, an educational and parental control application powered by AI. By accessing or using the Platform, you ("User", "Parent", or "Child") agree to comply with these Terms.

If you do not agree, please discontinue use of the App and website immediately.

2. Eligibility and Accounts

2.1 Parental Accounts

Only adults (18+) may create a parent account. Parents are responsible for:

• Managing and<bos>_managing linked child profiles
• Setting time limits and access permissions
• Ensuring accuracy of account information
• Reviewing AI educational interactions for relevance and safety

2.2 Child Accounts

Children can access the App only via a device token generated and managed by their parent. Child profiles:

• Contain only pseudonymized data
• Are strictly limited to educational features
• Do not require independent registration or personal identifiers

3. Services Provided

SAM&ME offers:

• AI-assisted tutoring, voice and vision learning tools
• Homework and study planners
• Progress summaries and learning analytics
• Device linking with parental dashboards
• Secure usage tracking and moderation

The App's AI features are designed solely for educational purposes and not for psychological assessment or therapeutic guidance.

4. Data Protection and GDPR Compliance

We comply fully with the EU General Data Protection Regulation (GDPR) and, for children under 13, the Children's Online Privacy Protection Act (COPPA) principles.

4.1 Data Collected

We collect and process:

• Parent data: name, email, profile preferences
• Child data: pseudonym, age, educational context, study habits
• Usage data: chat logs, planner events, session times
• Technical data: device ID, browser info, IP address (for security)
• Uploaded files: documents, images, and voice data used for learning analysis

No biometric, advertising, or geolocation tracking data is collected.

4.2 Data Storage and Security

• Hosted securely in the European Union via Supabase (PostgreSQL)
• Encrypted communication via HTTPS/TLS
• File storage via Vercel Blob
• Strict access control using Row Level Security (RLS) — parents see only their data

4.3 Data Rights

You have the right to:

• Access, correct, and delete data via your account settings
• Export your data ("Data Portability")
• Request erasure ("Right to be Forgotten")
• Withdraw consent or delete your account at any time

5. AI Features and Content Moderation

5.1 AI Interaction

Our AI tools (OpenAI GPT-4o-mini, GPT-5, Whisper, TTS-1, etc.) generate responses tailored to each child's age, school level, and preferred learning style. All conversations are automatically moderated to filter inappropriate or unsafe content.

5.2 Age and Safety Controls

• Conversations are filtered based on age
• Sensitive or adult content is blocked
• AI cannot engage in discussions unrelated to education
• Rate limits and spending caps are enforced for child safety

5.3 Limitations

AI responses may occasionally contain factual errors. SAM&ME does not guarantee the accuracy, completeness, or suitability of AI-generated content. Parents should supervise learning activities.

6. Parental Responsibilities

Parents must:

• Supervise children's use of the App
• Approve educational settings and permissions
• Avoid sharing login credentials or device codes externally
• Ensure the App is used for legitimate educational purposes

Parents remain legally responsible for all activity performed by their linked child profiles.

7. Acceptable Use Policy

You agree not to:

• Reverse-engineer, copy, or resell any part of the platform
• Upload malicious code, offensive content, or copyrighted materials
• Bypass time restrictions or parental controls
• Use the App for non-educational or commercial purposes

Violation of these rules may result in suspension or permanent deletion of your account.

8. Intellectual Property

All trademarks, interfaces, and source code are owned by SAM&ME or its licensors. You receive a non-exclusive, revocable license to use the App for personal, educational use only. You may not reproduce, distribute, or adapt any content without written consent.

9. Subscriptions and Payments

Some features may require a paid subscription. By subscribing, you agree that:

• Fees and currencies (EUR) are clearly stated before payment
• Plans auto-renew unless cancelled before renewal date
• You may withdraw from paid plans within 14 days under EU consumer law

10. Security Commitments

We use industry-grade protection including:

• HTTPS/TLS encryption for all traffic
• Role-based access control
• Row-Level Security (RLS) in database queries
• Continuous content moderation and rate limiting
• Periodic audits of AI interactions

If a data breach occurs, we will notify affected users and authorities within 72 hours, as required by Article 33 GDPR.

11. Termination and Account Deletion

Parents can delete their account anytime, which automatically deletes all linked child profiles and their data. SAM&ME may suspend or terminate accounts for:

• Misuse or violations of these Terms
• Fraudulent activity or security risks

Deleted accounts are permanently erased within 30 days, except when data retention is required by law.

12. Liability Disclaimer

• The Platform is provided "as is" without warranty
• We do not guarantee uninterrupted or error-free service
• SAM&ME is not liable for indirect or consequential damages
• Total liability is limited to the total fees paid within the past 12 months

The educational AI output is supplementary — it is not a substitute for qualified instruction or certified evaluation.

13. Governing Law and Jurisdiction

These Terms are governed by Belgian law. Any dispute will be handled by the competent courts of Brussels, Belgium, unless otherwise required by mandatory EU consumer laws.
